Clause 1: Booking Terms
- Booking Deposit
A deposit of 50% of the selected package or additional services is required to secure a booking. Reservations are confirmed on a first-come, first-served basis. - Final Payment
Before booking, customers should be aware of the total amount for the selected package or services. All booking details will be provided in the order, along with an official PDF statement issued by the studio. The remaining balance, after deducting the deposit, must be paid on the day of the photoshoot. Any additional charges for props or services (e.g., horse riding, boat rental, makeup) incurred will be settled together with the final payment.
Clause 2: Permissions, Service, and Photo Editing
- Creative and Artistic License
The studio shall be granted full creative and artistic discretion regarding the choice of locations and poses. The photographer, based on their professional expertise, will guide the session, and the customer should follow the photographer’s direction after ensuring their own safety. - Photo Style and Quantity
The customer acknowledges the photographer’s judgment regarding the style and number of photos. Factors such as weather, environment lighting, and the subject’s personality may affect the suitability of certain photos. The studio will strive to meet the customer’s expectations but cannot guarantee any specific images, backgrounds, locations, or poses. - Session Duration Each photography session is limited to 30 minutes. Any extension beyond the allocated time will incur an additional charge of RM100 per 30-minute interval. Customers are advised to arrive at Lifeview Studio early to avoid delays and ensure a full session.
- Attendance
The photographer will make every effort to photograph all individuals at the specified time, but will not be responsible for anyone missing from the session. - Customer-related Delays
If the photoshoot is disrupted due to the customer’s personal reasons, the photographer will not be held responsible. - Color Variations
Some color variations may occur due to uncontrolled lighting conditions and equipment. - Equipment Failure
The photographer will regularly check equipment and take reasonable measures to ensure backup equipment is available. However, the photographer will not be liable for losses due to accidental equipment failure during the photoshoot. - Background Scene
This package exclusively includes the use of Lifeview’s pre-decorated Christmas-themed background. Any request for additional or alternative background setups will be subject to additional charges. - Photo Editing
The package includes a one-time complimentary re-edit after the delivery of the soft copies. Any further editing requests beyond this will incur additional charges. - Photo Selection
All non-repeated soft copies of photos captured during the session will be provided to the customer. The photographer retains full discretion over the selection of photos to be taken during the session while striving to accommodate the customer’s preferences wherever possible.
Clause 3: Copyright and Ownership
- Right to Showcase
The customer allows the photographer to display the photos taken during the session for use in social media, website promotions, and sample albums. The studio will not use the customer’s photos for any commercial purposes beyond studio promotion. - Usage Rights
The photographer retains the ownership of the digital files. The customer is permitted to use the photos for personal purposes such as social media or wedding use, while protecting the copyright of the images. The customer is not allowed to use the photos for any commercial purposes, especially within industries related to the studio’s business. For special requests, the customer must negotiate and reach a mutual agreement with the photographer.
Clause 4: Force Major
In rare circumstances beyond the studio’s control, if the photoshoot cannot proceed due to complete photographic failure on the day, injury, or illness of the photographer, the studio’s liability will be limited to a full refund of all amounts paid.
Clause 5: Cancellation of Appointment
- Studio-Initiated Cancellation
If the studio must cancel the appointment due to uncontrollable reasons (e.g., illness, injury, or death), the studio will refund the full amount and will, out of goodwill, recommend other photographers to the customer. - Customer-Initiated Cancellation
Customers who cancel the photoshoot 15 days or more before the appointment are entitled to a full refund. Cancellations made within 8 to 14 days prior will receive 80% of the total payment. Cancellations made within 3 to 7 days will receive 20% of the total payment. No refund will be provided for cancellations made less than 3 days before the appointment.
Clause 6: Rescheduling
- Rescheduling Agreement
Upon cancellation, both parties can agree to reschedule, subject to the studio’s availability. All payments will be transferred to the new appointment date, with the cancellation terms applying from the original appointment date. If rescheduling fails, a refund will be issued based on the original terms. - Rescheduling Costs
The customer is responsible for reimbursing the studio for any incurred costs due to the rescheduling (e.g., accommodation, time-sensitive props). The studio must provide proof of the expenses to the customer.
Clause 7: Rescheduling Due to bad Weather
- Rescheduling for bad Weather
In the case of bad weather, both the studio and the customer must reach a mutual understanding to either reschedule or change the photoshoot location. - Bad Weather During Photoshoot
If bad weather interrupts the photoshoot halfway through, the customer has the right to reschedule the remainder of the session but must pay for makeup costs incurred due to the rescheduling. - Changes Due to Natural Conditions
The photographer reserves the right to alter the photoshoot plan, including the location, based on the weather conditions. If the customer refuses the changes, leading to a conflict with natural conditions, the session may be canceled without a refund.
Clause 8: Personal Safety
During the photoshoot, the customer is deemed capable of making decisions regarding their safety and will not hold the photographer responsible. The photographer is not liable for any personal safety issues, and customers should assess the safety of each situation.
Clause 9: Delivery and Format
- Raw Images
The “raw images” mentioned in the order refer to unedited JPG files generated by the camera during the photoshoot. - Edited Photos
Edited photos refer to JPG files that have undergone post-production after communication with the customer. - File Delivery
The studio will deliver digital files via a shared online link, and the customer must download the files within 30 days. If the link expires after 30 days, the studio is not responsible for re-sending the files. - File Format
The studio will not provide files in any format other than JPG.
Clause 10: Refunds
In the case of refunds, any costs already incurred (e.g., accommodation, credit card fees) will not be refunded. The studio must provide proof of such expenses.
Clause 11: Complaint Procedure
- Feedback on Photos
Customers must provide feedback on the photos within 1 week of receiving them. If no feedback is received within that time, the photos will be deemed satisfactory, and no further comments will be accepted. - Other Complaints
For other complaints, customers can contact the studio via email or phone. The studio will respond within five business days.
Privacy
The customer’s personal data will only be used internally by the studio and will not be shared with third parties. If the customer wishes to have their data removed from the studio’s database, they must submit a written request.
These terms and conditions were updated in Nov 2024. Lifeview studio reserves the right to modify its terms and conditions at any time and will notify partners and customers of any changes. The studio also reserves the right to the final interpretation of these terms.
